Der Knackpunkt bei der derzeitigen Wahlverzögerei:
Sollte der gesamte Wahl- und Auszählungsvorgang und die konstituierende Sitzung mit Premierministerwahl seit der Bekanntgabe der "organischen Gesetze" zum Wahlablauf die Mitte Dezember veröffentlicht wurden nicht innerhalb von 150 Tagen abgeschlossen sein (inzwischen ist schon ca. 1 Monat seitdem vergangen) besteht die Gefahr, dass die gesamte Wahl als ungültig erklärt werden kann.
Ab Wahltag sind ausserdem max 90 Tage bis zur amtlichen Bekanntgabe des Wahlergebnisses vorgesehen welche von diesen 150 Tagen abgehen was heisst dass die Wahl nicht später als am Sonntag den 10. März durchgeführt worden sein muss ohne dass das Wahlergebnis aus diesem "technischen Grund" vor dem Verfassungsgericht anfechtbar ist

Since our last assembly on January 8, our demand for clarification regarding the forthcoming election date has not been met. Up to now, the February 24 date as the day for Thais to cast their ballots is already impossible as the Election Commission would legally need 45 days (minimum) to organize the polls. This has made the junta’s effort for its fifth postponement of the election accomplished, witnessed by the global community.
Our patience with the Junta’s hypocrisy and propaganda is close to an end. We now demand the following:
1. “No more postponements” The date for the election must be set for no later than March 10, 2019. Any further delay might cause this election to be rendered unconstitutional if the EC fails to announce the result within 150 days of the electoral laws coming into effect. In such a context, the election result will be declared null and void. Thailand will have no more guaranteed timeframe for the country’s roadmap to democracy.
2. “No abolishment” of the election by any legal trick or accusation. All efforts to abrogate the election must stop.
3. “No extension” for the NCPO government and its leader to remain in power after the election. The use of the designed mechanism in the constitution to enable this regime to extend the power must cease. This includes the possible use of the 250 appointed senators to vote for an unelected person to the PM post, against the will of the voters, the avoidance to become a caretaker government and the arbitrary continuation to mobilize civil servants and to spend the national budget freely even during the period of the election campaign. The effort to extend the power also include the prejudicial treatment among political parties during the campaign. All these are considered as Electoral Fraud.
Failing to publish the royal decree on the general election by Friday Jan. 18 to enable the Election Commission to announce an election date will be taken as a sign of the government’s insincerity to return the power to the people. We will then be ready to elevate our effort to protect our constitutional rights and organize another assembly at the Democracy Monument on January 19 at 5 p.m.
